Driver drops bid to sue family of boy he killed

HARO, Spain (CNN) -- A Spanish businessman withdrew a controversial lawsuit Wednesday against the family of a teenage boy he struck and killed while driving a luxury car.

Tomas Delgado had filed a suit asking the dead boy's parents to pay him €20,000 ($29,400) on the grounds that the collision that killed their teenage son also damaged his Audi A-8.

News of the case sparked outrage in Spain and generated deep sympathy for the parents of 17-year-old Enaitz Iriondo Trinidad. He was riding his bicycle home to a campground when Delgado's car hit and killed him in August 2004

A traffic report said Delgado was traveling 113 km per hour (70 mph) in an area where the speed limit is 90 km (55 mph). An independent expert hired by Trinidad's family said Delgado was going 173 km per hour (107 mph

And you thought US Law suits were bad....

If he was speeding, then this might very well have been a contributory factor in the accident, so the car driver only has himself to blame. Having said that, if an uninsured party was to do damage to a car I was driving through their own negligence, I'd be after compensation. In this instance it sounds rather like the bloke is extracting the urine.

The daftest case like this happend in America. Where else? An office worker took a half day at short notice, and on the way back home had some sort of accident. They ended up in court claiming compensation as a result. Who was this person suing? The boss. The claim read that if the worker hadn't been given the afternoon off, then they wouldn't have been involved in the incident in the first place. I forget the outcome, but I hope the case lasted less than 10 seconds after the plaintiff's case was read out!
