The Martha Stewart case always seemed like an overzealous attempt by the Feds to “make an example” of someone. Not only I’d have no problem with a pardon for Stewart, I’d support retrying the case and open investigation on whether the Feds conducted the investigation and prosecution fairly. And I’m not even a Martha Stewart fan. |

It was a jury trial that found her guilty on all four counts charged against her: obstructing justice, conspiracy to obstruct justice and two counts of false statements under oath. Her broker was also found guilty on five similar counts. So two separate jury trials, and both parties were unanimously found guilty on all counts. Unless our criminal justice system is a sham (and granted it's not perfect, but it's probably the best in the world) I'd say there was a strong case. As to the notion that she wasn't guilty of insider trading, and these charges were all they could muster to make an example, well what say all of those who wanted to impeach Clinton on a perjury, i.e. false statement charge? This is typical of many white collar crime cases. The underlying case might be difficult to prove beyond a reasonable doubt, but lots of other chargeable offenses are come up during the investigation that are easily provable. And concededly, there are all too many white collar criminals getting away with murder (almost), but sometimes, making an example of someone will deter others. On a a personal note, and one that shouldn't bear on guilty or not, but maybe should as to the sympathy factor: Martha Stewart is a shrewd business woman (nothing wrong with that), but quite cold and heartless. My DIL worked for her a couple of years ago. She never had any problems with her, but she dealt harshly with her employees and very few people stay with her company more than 2 or 3 years. She also uses her more attractive employees as free models and spokespersons. My DIL was featured in one of her Halloween magazine special dressed as a zombie bride. She was also featured on an Employees Favorite Recipes cooking show. The employee feels honored to be showcased like this, but essentially spends hours and hours for the production as a model, but unpaid. The other gossip is that she owns a beautiful ocean side retreat near Bar Harbor Maine. Prior to her moving there, for many, many years it had been a favorite place for locals to herald in the rising sun on News Day, unimpeded by the previous owner. Once she moved it in, it was fenced off and guarded against the local riffraff. Edited by kathyk, Apr 29 2018, 08:03 AM.
