As Skeptical Scalpel says, there are four things that must be proven in a malpractice case...all four. 1) Duty to care - yep 2) Negligence - yep 3) Negligence caused harm - well, now it gets sticky. Was the surgery successful? What harm? 4) Significant damages - "emotional distress," yeah, right. In Illinois, we were told that the plaintiff must prove three things: 1) Damage occurred. 2) Damage was the result of the physician's actions 3) Those actions were outside the standard of care. His behavior was unacceptable and reprimand-able (is that a word?). Was it malpractice? I don't think so. |
