A jury was unable Friday to reach a unanimous sentencing verdict, which results in life in prison without parole instead of the death penalty for Holmes . . . One female juror later told reporters that there was no way to resolve the disagreement on what the sentence should be. "There was one firm holdout against the death penalty and two ... who were on the fence," said the juror |

Without expressing my opinion on the death penalty, here... You'd think, wouldn't you, that any attorney who was involved in jury selection on a potential capital case would have used his pre-emptive right so dismiss any juror so inclined. Isn't that a question that he should have asked? Possible that he ran out of challenges, however. Oh, and yeah, Holmes is nuttier than squirrel shit, but the jury decided that he knew right from wrong. Edited by George K, Aug 9 2015, 07:50 AM.

Yes, he could've run out of challenges; maybe he used up his challenges on dicey questions to do with insanity, and relied on juror reluctance to impose death. Or maybe some of the jurors were ambiguous in their replies regarding death penalty questions. LOL, very definitely Holmes was nuttier than squirrel shit, but he could have been judged to know right from wrong in law. Also, jurors may have been conflicted as to whether he was nutty enough to be put to death. If he was nuts he didn't deserve to die. If he wasn't nuts he could have earned the death penalty, but he was obviously nuts, so the question is moot! |
