Most recent Kafkaesque bit: the woman who demanded the picture of my home which "proves" the infraction has been cleared, rejected my picture. Of the place where my grill was. She's now demanding a picture of the FRONT of my home, where somehow she has gotten it into her head, the alleged infraction occurred. So now I'm proving that something that didn't happen, continues not to happen, by providing a picture of a place where it couldn't possibly ever happen. (There is no room in front of my home to fit a trash receptacle. If there were, it would still be rather bizarre to keep it there, since the trash is picked up in back of the home.)
As a good person, I implore you to do as I, a good person, do. Be good. Do NOT be bad. If you see bad, end bad. End it in yourself, and end it in others. By any means necessary, the good must conquer the bad. Good people know this. Do you know this? Are you good?

Horace, what a pain in the neck this has been for you. Tell her she's the one who has to provide the pictures of the infraction that never happened. Don't they have to document their reasons for the fines?

Thank you Brenda. I did tell her that. And wrote her that. She, in her professional incarnation, is not a thing you can communicate with. She is a thing of bureaucracy. And isn't it perfect that nobody can even spell that word without seeing the red line under it and then looking it up. This is not anything that anybody really gets.

They have no documentation, or evidence, of my alleged crime. They still *legally* penalized me for it, for nearly 3 grand. If I'd had gotten hit by a bus before I noticed, they'd have extracted that from my estate. If I'd have written the check, they'd have cashed it. It is evil.

These are ideas I tried to communicate to my fellow HOA members tonight. But ideas are a pinch of salt on a tongue.

What generosity! Billions!

It is inhuman because at some point real world laws can come into play. An estate might be ravaged if someone has some outstanding HOA dues upon their death, for instance. I mean, if the dues included some stealthy $50/day thing about a trash receptacle allegedly being visible to passersby.

Everybody reading this knows one thing with certainty: If I'd have written a check to the HOA for the full amount of the fine, they'd have taken it. And it would have been done and done. Please don't pretend these fines have no real meaning.

The HOA has legal power over us. We signed a contract. But we are a small bunch, and nobody but us cares about us, politically. The HOA can truly ruin lives if they want to. Or maybe just take advantage of an elderly person who's not as sharp as they used to be. We have to be careful. These fines are inhuman and they need to change.

Jezuz Horace. What a time sucking nightmare. I hope you can create hell for these people. And I agree with what you wrote in reference to elderly folk who can be targeted with this harassment. And yeah, I do view it as harassment because my gosh, this **** interferes with your rights to live peacefully within your own home and community.

Maybe you should let it ride at this point. If she tries to enforce the fine through a court action, perhaps you can bring a suit against her and/or the HOA for malicious prosecution or abuse of process.

However, if your HOA agreement includes arbitration, that tactic might not work.
