We can argue from now to eternity about Jolly's characterization of Ginsburg, but I do not believe you can argue that her actions are acceptable.

I can and did. The case is not relevant to a gay marriage in the state of New York and vice versa.

Imagine if some gun control measure in Chicago were headed to Scotus. Say one of the justices goes duck hunting now and then. Should he recuse himself?

Your analogy only works if duck hunting is a controversial issue that the justice knew prior to going duck hunting was going to land on his desk for him to rule on.

Since duck hunting is legal, and the legality of duck hunting is not a controversial issue, and since duck hunting has absolutely nothing to do with gun control, it isn't germane (see how I worked that in? hehe) to this discussion.

You're making my point. The case before the court has fvckall to do with gay marriage in New York. Regardless of how the court rules, gay marriage will remain legal in New York.

Maybe. Maybe not.

If the court rules in favor of the plaintiffs, gay marriage pretty much becomes accepted nationwide. But what if they rule against?

Then states will be allowed to prohibit it. But New York passed gay marriage legislatively. It wasn't imposed by the courts over the will of the electorate or legislature like has happened in many other states.

Had she officiated in one of those states (of which there are many), you'd have a much better point.

Jon, you are in Axmode, missing the point entirely.

well what is the point then, specifically?

If it is "Some people are against gay marriage, some are for it. Ginsberg came out pretty clearly that she's in the latter camp". Then I say, so what? The issue before the court is not that broad.

In my defense, I was left unsupervised.

I think the main point is that America is teetering on the brink of something or other.

Again.

The point is a justice should not be giving very public displays of how she will rule on an issue before the court.

Jon's point is that she isn't. Supporting a State's right to decide for themselves isn't the same thing.

Personally, I think she'd have been better not attending, but also the initial comment in the thread is a total over-reaction.

People just need to calm the f*ck down

I disagree. I think it is part and parcel of a sense that people feel themselves larger than the responsibilities they have accepted.

I am quite calm. As I said, you can argue against Jolly's choice of words, but that's just blowing smoke to obscure the larger issue.

Maybe the nature of debate in this country is the larger issue.

Nyet.

Debate in this country has always been boisterous, sometimes even featuring blunt instruments. We're pretty tame puppies compared to what we've been in the past.
