I don't care about football, but I completely support Brady's refusal to let the NFL inspect his personal phone. No trade group should have the power to force inspection on individual member's employee's personal phones.
If they could force it, they would have. That he refused is proof that they couldn't, and never tried to, force it.
By citing that as a reason for Brady's punishment, the league is trying to establish a precedent that they can indeed force it. The NFLPA will bring that up in court.
Civilisation, I vaguely realized then - and subsequent observation has confirmed the view - could not progress that way. It must have a greater guiding principle to survive. To treat it as a carcase off which each man tears as much as he can for himself, is to stand convicted a brute, fit for nothing better than a jungle existence, which is a death-struggle, leading nowhither. I did not believe that was the human destiny, for Man individually was sane and reasonable, only collectively a fool.

I hope the gunner of that Hun two-seater shot him clean, bullet to heart, and that his plane, on fire, fell like a meteor through the sky he loved. Since he had to end, I hope he ended so. But, oh, the waste! The loss!

I agree that New England will save its hate for two middle class townies caught up in something their jobs almost certainly depended on, and continue to worship a native Californian who, through relentless cheating, managed to steal a few championships for them.
How prescient. The townies got fired. From today's NYT:

The whole NFL has known about the Pats' systemic cheating for years, but the culture is strong and nobody complains, except in private.

The cracks are coming apart now though.

Last night, Tomlin of the Steelers was actually willing to accuse the Pats of screwing with his coaches' headset. He's known about it for years, but everybody is just sick of the Pats' cheating now.

The asterisk over the era will be in bold print, and that's a done deal.

It's really a shame. I mean, even though Brady is a gutless, soulless, cheating coward, terrified of who he truly is behind his fame and ill-begotten respect, he is good looking. That should count for something.

I'll never forget how Tomlin reacted after the Packers beat him in the 2010 superbowl. Losing a sudden death championship game is about the most emotionally difficult thing pro athletes or coaches face. Watching him make a point of stating that my team earned the win and that he won't countenance any other interpretation, was really impressive. It was important to him to say that. I've been a fan of his since.

That's the guy who finally decided that he'd, on his own behalf and on the behalf of the rest of the NFL, finally break the silence about the sportsmanship cancer that is the New England Patriots, Bill Belichick, and Tom Brady.

Lifetime bans would be too good for that lot.

The NFL culture is all about manliness. Or actually it's all about money. People do keep quiet about little pussies like Belichick, who grew up the son of a coach and learned all there is to know about how to win, and then added some... mostly about bending rules and all that.

Why do they keep quiet? Because of a code of honor?

That's a joke.

It's about the money. All of them are either thankful for the money they've earned, or hopeful to earn more of it. That's the code.

If he did, he'd worry less about his headsets and more about his porous defense. The Ravens will absolutely own his @ss in their division if he doesn't fix it.

His conclusions on Deflategate are interesting in light of his disdain for the Patriots, and his initial assumption of Tom Brady’s guilt.

To better understand Judge Berman’s ruling and the impact in the case, we join Robert Blecker who’s educated opinion was formed after spending “hundreds of hours” pouring over facts, documents, and details related to DeflateGate.
Blecker concluded:
We know at least the NFL cheated, and the Patriots may have, my best guess is that it never happened.
– The NFL cheated if you define cheating, as I think it should be, which is the deceptive attempt to gain an unfair advantage, by violating rules, the letter and spirit of rules.
– If you look at the unfair advantage in the investigation from start to finish, there was a deceptive attempt to gain that unfair advantage by the NFL.
– They leaked incorrect figures, as to how much the balls had been deflated
Belichick/Bradypress conference made them look guilty, but the reason they couldn’t explain it was because it wasn’t to be explained, it never happened.
– Well’s concluded he was “generally aware,” however there is no “standard of general awareness…it’s not found anywhere…it’s not listed anywhere.”
– Never been a suspension for an equipment violation, for refusing to cooperate in an investigation, yet Brady was suspended 4 games
– The punishment was disproportionate to the crime, if the crime happened; there was no adequate notice

Blecker midway through highlighted Judge Berman thought the pretense that the Wells’ Investigation was “independent” was a joke. Interestingly in Judge Berman’s ruling, he puts right in front “independent” in quotes or bolded for emphasis, every time he mentions the “Independent” Wells’ Report.

It was clear to Professor Blecker, “there was no independence here, this was an in-house investigation.” He also noted, some commentators/talking-heads have pointed out Goodell acted as “judge & jury.” I’m fairly sure anyone who has taken Business law, or is a human being with an understanding of basic human right & fairness that “a person cannot be a judge in his own case,” as we’ve learned from western culture for thirty centuries.

Tom Brady will not miss the Super Bowl because of the Deflategate saga.

The U.S. Court of Appeals for the Second Circuit in New York yesterday allowed a joint request to expedite the appeals process. However, oral arguments “shall be heard as early as the week of February 1, 2016,” according to a court order released yesterday.

The Super Bowl will be played Feb. 7, 2016. Even if oral arguments are heard the week of Feb. 1, it would be unprecedented for a federal appeals court to render a decision that quickly.

NFL attorneys have to file their opening brief by Oct. 26, and union attorneys representing Brady will be required to respond by Dec. 7. The NFL has until Dec. 21 to reply.

Lawyers for both sides asked to expedite the process last week. The league has appealed to overturn a judge’s decision to erase the four-game suspension handed down against Brady by commissioner Roger Goodell.

Earlier this month, U.S. District Court Judge Richard Berman vacated Brady’s four-game suspension, which Goodell handed down after he determined the Patriots QB was involved with an alleged scheme to deflate footballs before last year’s AFC Championship Game against Indianapolis.

Berman found Brady had no notice that he could be punished for being “generally aware” of the misconduct of others. He also ruled Goodell was incorrect when he denied Brady’s attorneys access to certain investigative files and didn’t allow them to question NFL lawyer Jeff Pash, co-author of the Wells Report — the lengthy investigative document that found that Brady was at least “generally aware” that footballs may have been partially deflated.
