Brother, down here, "church" is the same as saying "place of worship". Kinda in the same vein as calling all sodas, "coke" or all facial tissues, "kleenex". I even heard the local rabbi on the radio the other day talking about his church services... |

You're missing the point, George. She's not implying, as you are, that religious discrimination protections only protect Christians. She said there was no discrimination because everyone got the discount - even those who didn't have a bulletin. In other words, you can say you give price preference to a religious group as long as you don't actually go through with it.

You can call it dancing if you want, but you totally misinterpreted the MD ruling. The judge did *not* decide it wasn't discrimination because any church bulletin would do, she decided it was not discrimination because *no* bulletin was necessary to get the discount. |

This is so stupid. Is a business that requires the public to enter into its premises for any reasonable length of time considered a place of public accommodation? Yes; this has been the legal status of businesses for a long time now. Is the church bulletin discount technically discrimination? Of course it is. Is there anything significantly discriminatory about it? No, and people should be mature enough to recognize that these kinds of microdiscrimination are common in any number of settings across racial, ethnic, religious, or ideological spectrums, and overall, are all pretty insignificant. If there is someone sufficiently sensitive that they want to make a lawsuit about this kind of discrimination, is there a smart way for a restaurant owner or similar business owner to avoid lawsuits like this? Of course. Simply change from offering a "church bulletin discount day" to a "religious observance discount day," followed by some other day of the week being an "atheists and agnostics discount day." That way, no one is discriminated against. And if the point of the discount is to drum up more business, even more should be drummed up by expanding the total population being extended the enticement to use the business. And if the business owner would balk at such an across-the-board type of discount, and wants to truly favor one religion over another in his/her place of public accommodation, then maybe they really should consider their motives, its legality, and whether it is enhancing or detracting from potential business.They should pause to consider what actual message they're conveying to their total customer base, and even whether their actions have a positive or negative role in carrying out the teachings of the faith their actions seem designed to promote or encourage. In other words, the most "Christian" kind of restaurant discount, that would actually promote the faith if that's the restaurant owner's intention, might actually be to extend it to non-Christians, or people who could show need by presenting a welfare check stub, or a food stamp swipe card, or something like that. |

I think that people are getting hung up on the religious aspect of this. As I mentioned in my first post in this thread, people who are not members of AAA were not qualified to get a discount on their auto purchase. That's discriminatory, isn't it? I remember reading (here) that discrimination involves a easily identifiable group - blacks, women, the disabled, etc. That's not the case here. And I love Dewey's suggestion: "Atheists Day." Then, perhaps, we can have "Agnostics Day" (it should not be conflated with atheists, you know), followed by "Zoroastrian Day", followed by.... |

George, I think the distinction is that there are particular *types* of discrimination that are legally prohibited in order to meet Constitutional muster, and those types would include lining out, or granting special privileges for, things like race, sex, ethnicity, or religion. Theoretically, members of any race, sex, ethnicity, or religion may be an AARP member, or a Boy Scout, or AAA, and so on. Those sorts of discounts/preferences cut across the Constitutionally-protected divisions. And to avoid all the hundreds of potential religious discount days, that's why I just suggested one, for all religions, and one, for all "non-religions." ![]() Still, if the restaurant owner were my parishioner, and s/he came to me to discuss the problem, thinking that their offering the "church bulletin discount" was an important way for them to support and encourage their Christian faith, I'd just offer the thought that the discount that would be the most consistent with, and helpful to, the Christian faith, would be that one offered to a struggling single mom on WIC, or the person who had a receipt from a homeless shelter, or someone in similar tough times, who might really, really appreciate a nice home-style Sunday meal. And that if anything, a church bulletin discount could send the wrong signal that we Christians are in some way deserving of special privilege, or that we're in some way better than, the rest of our neighbors, and we don't want to project that message, intentionally or otherwise. That would be my take on it, and my advice to my restaurant owner/parishioner, anyway. |

This is why we need less government, fewer liberals, and even fewer gobsmacked goody two shoes preachers. If you took the time to look at the demographics of the town you'd find that it consists of around 10,000 people, mostly Catholic, Amish, Mennonite, Methodist, etc. Most of them are going to have a church bulletin, they are probably already taking care of the needy, and they most definitely don't need a federal government dictating to them how they need to worry about offending a Jew or an atheist or whatever else you care to toss into that list when the odds are there isn't a Jew or an atheist among them. The owner of the business ran an ad trying to drum up a little business. Some outside know it alls have decided to stick their noses into the man's business. Get the f*ck out of his way, leave him alone, shove the touchy feely nonsense and the "one size fits all" big government stupidity square up your ass - and if you don't like what he's doing, don't go to Columbia Pennsylvania and eat at his restaurant. |
