Liability insurance is the issue, so we're told.

Lifeguard fired for saving man outside of designated zone

I find it interesting that other lifeguards were also fired for saying they would have done the same thing. It's a real dilemma. If liability issues really are large (and this isn't just a smokescreen), then the firm that supplies lifeguards (and all other such firms) might not be able to operate. The effect on tourism could be .... interesting.

So, couldn't there be exposure to a wrongful death suit if the guy just lets people drown? I would hate to be the attorney who had to make the case that he should have before a jury.

Some uncomfortable questions ...

Recall we had a thread about a fire department that only protect households that have paid-up for fire protection. (Article: http://news.yahoo.com/blogs/sideshow/tennessee-family-home-burns-while-firefighters-watch-191241763.html )

If a fire fighter rushed into a house to save a life, knowing full well that that household has not pay for fire protection, should said fire fighter be fired (or somehow disciplined), too?

There is something to be said about the moral hazard of bailing out people who decided to take risks and lost (e.g., drowning while swimming in beaches without lifeguards, house on fire while living in houses without paying for fire protection, losing big while making bets in the financial markets without sufficient reserves) ...

But when it comes to public safety, does it make sense to draw lines? If you draw lines, how do you enforce them? When **** happens, do you blame the guy who crosses the line or the guy who stayed behind the line?

If you say "common sense" and "case-by-case," how the heck are you going to draw up the actuarial tables to quantity such "common sense" and "case-by-case" approach to doing things?

It's easy to draw those lines when making up rules. Not so much so when you see someone whose life is in danger. There simply has to be some protection for people who act in good faith to help another, regardless of outcome.

The common sense part of it really boils down to this: what kind of behaviors do we want to encourage and protect in our society?

I don't agree with laws that compel you to act, one person's perception being offerent than another's, but the protection needs to be there if they do.

I share that objection as well. Luckily, in the US, Good Samaritan laws do not compel one to act (VT and MN are the only exceptions in the US in this regard as noted by Wikipedia).
