Khalid Sheik Mohammed, the self-proclaimed mastermind of the Sept. 11, 2001, attacks, will probably remain in military detention without trial for the foreseeable future, according to Obama administration officials.

The administration has concluded that it cannot put Mohammed on trial in federal court because of the opposition of lawmakers in Congress and in New York. There is also little internal support for resurrecting a military prosecution at Guantanamo Bay, Cuba. The latter option would alienate liberal supporters.

The administration asserts that it can hold Mohammed and other al-Qaeda operatives under the laws of war, a principle that has been upheld by the courts when Guantanamo Bay detainees have challenged their detention.

The White House has made it clear that President Obama will ultimately make the decision, and a federal prosecution of Mohammed and four alleged co-conspirators has not been ruled out, senior officials said. Still, they acknowledge that a trial is unlikely to happen before the next presidential election and, even then, would require a different political environment.

After all the bold talk during the campaign, the harsh reality of what to do with this guy has gobsmacked the administration in the face. Rhetoric is easy, governing is hard, just ask the New York Times.

Oh, and we're coming up on the first anniversary of the expiration date of the promise of closing Guantanamo.

Maybe Bush had it right with military tribunals after all, eh?

The only consequences of keeping KSM in indefinite detention would be - if one takes Obama's 2008 campaign statements literally - to undermine the Constitution, destroy U.S. credibility around the world, and deliver a boost to terrorist recruitment.

In June 2008, candidate Obama exchanged criticisms with Sen. John McCain over the war on terrorism. "It is my firm belief that we can track terrorists, we can crack down on threats against the United States, but we can do so within the constraints of our Constitution," Obama told ABC's Jake Tapper. "Let's take the example of Guantanamo. What we know is that, in previous terrorist attacks - for example, the first attack against the World Trade Center, we were able to arrest those responsible, put them on trial. They are currently in U.S. prisons, incapacitated."

Obama continued:

And the fact that the administration has not tried to do that has created a situation where not only have we never actually put many of these folks on trial, but we have destroyed our credibility when it comes to rule of law all around the world, and given a huge boost to terrorist recruitment in countries that say, "Look, this is how the United States treats Muslims."

And now we have a situation in which Obama, after nearly two years as commander-in-chief, is reportedly planning to continue the indefinite detention of KSM - no charges, no trial.

The Left's outcry of rage against Bush has turned into a tsk-tsk.
It's a bit like all the GOP howling over public spending, which fades into a sort of Kreecher-like muttering when a neo-con is in charge.

You keep wheeling out that parallel, even though every time you do we have to remind you that a lot of us conservatives criticize Reagan and Bush for not reining in spending, and I don't know of any conservatives here that are neo cons.

Try again.

Fine. Then have him shot- probably should have after he was waterboarded and sang like a bird.

Not only is he guilty but he's probably barely human.

Take him out and shoot him then move on.

Fvcking terrorists.
That's pretty presumptuous of you isn't it?

I mean, no trial, or anything. All you have is his word that he did what he did (oh, there's that pesky Nick Berg beheading too). I'm sure that it wouldn't stand up in court because he didn't have an attorney sitting at his side when he said what he (allegedly) said.

I'm just saying...

Oh yes, the criticism of Bush from the right was truly overwhelming. I could hardly hear myself think because of the noise.

Might that be construed by some as torture?
