Portland lemonade stand runs into health inspectors, needs $120 license to operate

It's hardly unusual to hear small-business owners gripe about licensing requirements or complain that heavy-handed regulations are driving them into the red.

So when Multnomah County shut down an enterprise last week for operating without a license, you might just sigh and say, there they go again.

Except this entrepreneur was a 7-year-old named Julie Murphy. Her business was a lemonade stand at the Last Thursday monthly art fair in Northeast Portland. The government regulation she violated? Failing to get a $120 temporary restaurant license.

Turns out that kids' lemonade stands -- those constants of summertime -- are supposed to get a permit in Oregon, particularly at big events that happen to be patrolled regularly by county health inspectors.

"I understand the reason behind what they're doing and it's a neighborhood event, and they're trying to generate revenue," said Jon Kawaguchi, environmental health supervisor for the Multnomah County Health Department. "But we still need to put the public's health first."

Luke and his friends ran a Lemonade Stand two weekends ago for one hour, down by our community pool. Not inside the pool itself, but on the corner. They sold 36 cups in one hour. Would have sold much more, except five gallons of lemonade were stored rather haphazardlt in out refrigerator, resulting in a 1/2" deep lake of lemonade in our kitchen. Besides, the kids were starting to get hot and wanted to get into the pool.

This part of the response, I disagree with. You want to learn about business, learn about laws and regulations and compliance issues, too, as they are essential parts of doing business. If you're not willing to comply with existing laws, do not do business in public. You can practice "doing business" in your private premise selling lemonade to your relatives and friends. But I expect you, regardless of your age, to comply with all laws and regulations if you want to do business in public and sell to the public.

Tree house and use of union personnel - depends on how your local zoning and building codes, and your state's labor laws, obviously.

Also don't forget to consider liability issues, e.g., double check any tree house exclusions that may be in your current home-owner's insurance and get proper tree house rider as necessary.

I tried to have it written into the birthing contract that diapers could only be changed by registered Union members. Sadly, I was informed that a birthing contract was unnecessary, and in addition that I would be sleeping on the couch for the foreseeable future, with the baby monitor.
What do you mean "we", have you got a mouse in your pocket?
