WTF?!?!?! That's retarded.
They just set the terms they want for the mission they want, regardless of past reasonable standards. My guess is that by doing away with the idea of preferring previous judges, they are paving the way for Obama to either self appoint or for consideration based on "precedent".

And it's not as if he'd be appointing someone who didn't know the law. The Dean of Harvard Law is pretty qualified.
