Bush Officials Do Not Support ALL Terrorism Trials Before Military Commissions

They say both civilian trial and military commission options should stay open.

Among other reasons, many European countries won't extradite unless it's for a civilian trial. That's why the Bush Administration apparently promised to try several suspects in civilian courts.

Quote:

Juan C. Zarate, who served as deputy national security adviser for combating terrorism to Mr. Bush from 2005 to 2009, does see value in the military tribunals. But he still argued that the government would hamstring itself by outlawing civilian terrorism trials.

“We shouldn’t inadvertently handcuff ourselves by taking this tool completely out of our tool kit,” Mr. Zarate said.

An Assistant AG for national security under Bush is quoted to the same effect.

Imagine that. Bush Administration officials think it's appropriate sometimes to use civilian trials for terrorism suspects. Just as if they were criminals.

For totally different reasons. The Bush admin wanted to be able to get their hands on the perps. The Obama admin wanted to stick NYC with a high dollar dog and pony show for public consumption.

Substance versus style. Which do you want in a presidency?

Now that we've established your acceptance of their opinion as being worthy of consideration, do they think that it's appropriate for KSM to be tried in a civilian court?

Let's stick to substance. There's a bill written by the Republicans in the Senate barring the Obama Administration from ever using civilian trials, and requiring all terrorism suspects to go military commissions.

And several people here have said that it's inappropriate to use civilian trials for terrorists. Without a caveat.

Do you agree?

Not if it prevents us from trying them at all, of course not. But that is of course not the case with KSM.

I don't think Congress should be mandating what process is used across the board. There have always been cases that fit better for a civil process than a military and vice versa. The President should have the flexibility to decide which is best in terms of our national security. It is just that Eric Holder (and Obama) seem to like getting these backwards.

There is a line we cross when we go from "I will believe it when I see it" to "I will see it when I believe it".
