Reid: Roberts 'didn't tell us the truth'

Senate Majority Leader Harry Reid said Friday that John Roberts misled the Senate during his confirmation hearings by pretending to be a moderate — and that the United States is now “stuck” with him as chief justice.

“Roberts didn’t tell us the truth. At least Alito told us who he was,” Reid said, referring to Samuel Alito, the second Supreme Court justice nominated by President George W. Bush. “But we’re stuck with those two young men, and we’ll try to change by having some moderates in the federal courts system as time goes on — I think that will happen.”

Reid’s comments, which came during a wide-ranging discussion hosted by the Christian Science Monitor, reflect Democratic concerns that Roberts presented himself as a neutral arbiter of the law but has wielded a relentlessly conservative agenda. Republicans reject the attacks, saying Roberts has been a fair judge and has been consistent in his opinions.

Although Reid said that Democrats will try to put moderates on the bench, he said he will not try to deny Republicans the right to filibuster nominees. In 2005, then-Majority Leader Bill Frist threatened to eliminate the filibuster, sparking a furious reaction by Reid and other Democrats who said the so-called nuclear option would quash the rights of the minority.

“As I said at the time, the nuclear option was the most important issue I’ve ever worked on in my entire career, because if that had gone forward it would have destroyed the Senate as we know it,” Reid said.

“If the Republicans want to filibuster a judge, that is directly contrary to what their political philosophy was, but I guess it’s all subject to change,” he added.

Reid called GOP efforts to block President Bill Clinton’s judges “a dark point in the history of our country. I would hope we don’t have to go through that again.”

You are getting yourself in deeper and deeper. Bork is an even worse example, because he got a vote in the Senate, and the Senate voted him down. 58-42, with several Republicans (and Richard Shelby, soon to become a Republican) voting against.

We're not talking about whether the Republicans should be rubber-stamping nominees to the Supreme Court. Let them vote their conscience. But vote. Just like they were arguing a few short years ago. No filibusters.

Better hope you don't get what you wish for. It's unlikely, absent a sea change, that Republicans will take the Senate in 2010, and next in line would be Dick Durbin and Chuck Schumer. I doubt you'd like them any better.

You're right, Quirt. The whole government, as I see it, (and as many other people see it), is way out of control. It has grown itself into a monster and everything is so impossibly tangled up, no one can even begin to tell where to start, in order to fix it.

Yeah, I blame the Republicans. The Democrats haven't done any better, though. What an awful mess...

You are in fact mistaken.

Let me remind you. I was the one who said, at the time, that it was taking filibustering too far. And that filibustering is supposed to be reserved for exceptional circumstances, like it was before the 1980s. And that, if it can't be used with restraint, the tool should be eliminated.

I recall no such thing. You claimed, essentially, them's the rules so let them fillibuster to their heart's delight. I tried to make a case for restraint using the fillibuster for judicial appointments given the President's plenary power to appoint under the Constitution but you, again as I recall, would have none of it. If the rules allowed it then let it be done.

You recall incorrectly.

My view then, as expressed then, remains as it is now. The filibuster has outlived its usefulness, because of the lack of restraint in using it. Forget the "nuclear option" ... it should be ditched entirely, and the Senate should vote on a majority basis.
