I wonder can we limit executive compensation without seeing a brain drain in the industry? Not that he brains there today have been particularly astute lately, but just wondering if the unrestricted market will draw the best people away from the restricted market.
My personal experience is that the amount those guys make, above a certain threshold, is all scorekeeping. Fred's primary focus is that he makes more than Gary, and Gary is trying to catch up with Fred and stay ahead of Bill.

Really, is the difference between $20 million and $30 million per year going to cause someone to move their whole family overseas?

Seriously though, they'll only cap cash comp, so bonuses will still be paid, just in stock or in some sort of paper that defers payment until the feds are reimbursed.

Considering the mess I'd let the "brains drain". There should never have been a bailout of any financial company - the stockholders, who elected the Board's of Directors, who hired the brainless morons, should be left holding the bag. I also have a new good use for Guantanamo - incarcerate the US's most vicious terrorists - the ones who have done the most to bring the country to it's knees. Madoff, Thain, the ceo's of WaMu, AIG, Lehman Bros., etc.... , Weill, Greenspan, .........

Thain fights back (as if this absolves him or something!):

Bank of America was aware of everything

All this is equivalent to firing a missile into the Bank of America (BAC) boardroom. Bank of America and CEO Ken Lewis tried to blame everything on Thain last week. Assuming Thain is right that BAC knew about the bonuses and Q4 losses (and it's almost inconceivable that they didn't), responsibility for the incompetence and outrageous bonus decision falls squarely back on Bank of America...and still-employed CEO Ken Lewis.

He's also saying he will pay back the $1.2 million spent on office decorating (probably wants the furniture he carefully picked out).
