Oh, and Scooter should be a given, I'd think.

I doubt he'll pardon Cheney, though. If I had to guess, I'd guess there have been discussions with the Obama team, and a deal has been cut ... no pardon for Cheney, but no prosecution either.

I didn't say it was going to happen. I said that it's a possibility, and it's certainly something people ... people who will have positions in the White House and the Department of Justice ... are talking about.

Personally, I think they're fairly well-insulated by the BS opinions of counsel they got from lackeys at the DoJ. I think the opinions were wrong, but in these sorts of cases you rarely get indicted if you relied on advice of counsel.

But for you to say it's fantasy? It shows that your grip on reality is becoming untethered. If the President-elect is talking about the possibility, it's not fantasy.

The president-elect has talked about a lot of other things in the past that turned out to be just that. Fantasy.

Is there US statute prohibiting "torture?" Is there, in that statute, a definition of what "torture" is? Not, what Obama says "in my view." His view doesn't matter. It's the view of the law.

You guys will have a stronger case that it's much ado about nothing if Bush issues no pardons next week, relating to interrogation tactics. If he does issue any pardons relating to interrogations, you guys are going to look even more foolish than usual pretty foolish.

Personally, I don't think he will, but I understand that there are a few people who'd really like him to.

I don't think his issuing pardons would mean much either given all the damn fools in Congress who want to pursue these matters. It would merely be a prophylactic move just in case of the off chance that something got going.

I don't know enough about who is in the running for a pardon, but I will bet that that Libby will not get a pardon. He's already in the clear and a pardon now would be tantamount to admitting he should have pardoned him fully way back when (which I think he should have done).

You know who I wish would get a pardon? Bill Clinton for perjury and Hillary Clinton for obstruction of justice. That'd be a hoot!

There were some pro-prosecution nutjobs on Diane Reems this morning. Crazy. Why on earth would the new administration want to go backward acrimoniously, with the tasks that face it going forward?

Trying to prosecute Cheney, or especially Bush, would be the quickest prescription I've heard yet to deliver a Republican majority in congress in 2010. Only the nutters want this.
