Suppose one of the VT students was carrying a gun. Suppose that as the shooter went from class-room to class-room, one of the students pulled out his gun and killed the shooter, saving not only his own life but also those of other students/faculty. Would he get time in jail for murder? Would his sentence be harsher if he had killed the shooter early on, after only 5 or 6 students had been killed? Would his sentence be lighter if he had killed the shooter only very late, after 30 students had been killed? Had he caught the shooter early on, we'd never know how many students he would have saved. |

No. If a student happened to be carrying a weapon and shot a guy who came into a building armed with two weapons and God knows how many clips, chained the doors shut and began shooting people randomly? There would be no charges brought. If it were me I would not think twice. At that point the shooter has ceased being human and can only be viewed as a threat. That is the only rational approach. |

I'm pretty anti-gun, but I have to say that if some civilian shot this guy I would be appalled if there were charges brought against him/her. Even if he had "only" killed one person at that point. I think from the descriptions of the vest he was wearing and the barracading the doors, it was pretty obvious that he was going to take out as many people as he could. |

Exactly my point. Prosecutors have to convince a jury of the accused peers to convict him. No prosecutor, no matter what the law is (and self defense would apply here) would want to take a case like this in front of any jury. There would be no prosecution. If, for some reason, a prosecution were brought, do you think a prosecuter could get a unanimous vote (or even a majority) to convict? It's an interesting quesion in theory, but a no-brainer in reality. |

It wouldn't even get as far as a trial. The DA that brought that case to court would be tarred, feathered and ran out of town on a rail. What's happening to Nifong would look like a gentle breeze as compared to a hurricane. |
