We use the tax code to make social policy all the time. I can think of few things better for society than the promotion of marriage.

But I was just told that there is a "marriage penalty". How is that promotion of marriage?

Plain and simple, as much as Kenny would like to see the 'haters' behind this, they're just not there.

So you're working diligently toward a more fair and equitable tax arrangement for Kenny and his partner?

Go post some more of your racist humor Miller.. jeez.. how inconsistent can you get?

The only thing that is inequitable here is the marriage penalty. Kenny's tax situation is the same as any other unmarried couple.

I think the bottom line is...what is the point of tax and insurance benefits?

Let's start there.

The difference is that Kenny is not allowed to get married, penalty or no.

That has nothing to do with the tax code, and I have already come out many times in favor of gay marriage or civil union.

Not if it works the same for a hetero couple.

But it doesn't.

Medical benefits given to married people are tax free for BOTH the employee and the spouse, and all of their 99 children too.

Medical benefits given to single people are tax free also.

Only medical benefits for domestic partners are taxable.
AND NOT ONLY IS THE PART OF THE BENEFIT THAT PAYS FOR THE PARTNER TAXABLE, THE PART FOR THE EMPLOYEE IS SUDDENLY FOR SOME REASON TAXABLE TOO. :mad2:

The Gay Penalty.

IRS rules.

Hawaii has 0 laws that California has requiring (or even allowing) domestic partner health insurance. It does not exist here. Go to work, work as hard as everyone else, pay your taxes, pay more for YOUR health insurance BECAUSE you are not married. I do not know why you think you are being discriminated against (sarcasm).

Daniel, I dont think it's discrimination (in the negative sense) to pay more for health insurance because you aren't married. I think that's just the application of the rules and criteria. However, if one does argue discrimination, then it would have to be applied to the definition of marriage, but not to the rules of a company/insurance policy.

It's like if you went to a soda machine and you pressed the Coke button, but out came a Sprite. Would you be mad at the button or even the machine? Or would you be mad at the person who stocked the machine incorrectly?

Just another horrible 89th Analogy(tm)

So like I've been saying...what is the point of giving health benefits and tax breaks to families? We should start there.

I would think it's generally to encourage not only a family sticking together, but also to help them grow financially.

This is Federal.
IRS rules.

I have not yet looked into whether health benefits for domestic partners (AND THE MUDDER-FARKING EMPLOYEE TOO) are considered taxable by my state.

BTW, today I told my doctor about this.
He said, "The federal government doesn't like people who aren't straight. This is their way of getting back at you. They used to not like blacks, then women. Give it time."

I may call the ACLU on this one.

I think it is a slam dunk case of discrimination.

They'll probably say, "You can't sue the government, or write a letter to your Senator" or something.
