John, I'm no lawyer, but yes...yes, I think dressing up in black, putting on a balaclava helmet, and raiding the local CD shop armed with a high-velocity water pistol containing skunk-urine, smashing the window, rushing in and grabbing as many CD's as you can, is illegal. |

I never download music. I do however borrow CD's from the public library and burn them onto Disc at home on my machine- including the newer discs that supposedly cannot be recorded. |

mp3 is a good compromise for most people. If I play an mp3 ripped from a cd (using 120kBits/s) for my wife she wouldn't notice the difference from the original cd. I'm not sure I would either, unless I had a high end audio system and a quiet room. The compressed file allows more music to be stored on a 20GB disk drive than if it were kept in it's original form. Nothing wrong with being a purist - but it's not necessary for all. (McDonalds sure sells a lot of burgers, even though the burgers are not particularly good). My kids download from itunes - they generally chose this option if they are only after 1 or 2 tracks from a cd. Otherwise they buy the cd. Apple - did you read that they are again being accused of stepping past their bounds? Apple records is in the music industry - Apple (computer) was only allowed the Apple name as long as it did not move into the music industry. It's Jobs against John, Paul, George and Ringo! |

I think downloading is great. It frees you to buy only what you want, rather than having to shell out for the entire album. I can get a 3-movement symphony for $2.97 on iTunes. Can't beat that. I actually have accounts on a bunch of different sites--iTunes, RealPlayer, Napster, yada yada. Different sites have different music. iTunes is best for classical, IMO. |

Depends on the compression. Radio is usually 64 or less... 128 is decent for most people... 160 and 192 are my favorite (file size isn't that bad, but the sound quality is great....a fine equilibrium) 256 and 320 are CD quality... |

I agree that 192 kb is the best compromise between quality and size. Back in the days of Napster (the old version) and Bearshare, I would cruise looking for only 192 kb files. I download from iTunes all the time. The quality is good enough for my ears, and it means I can have the couple songs I like by artists. But i'll also buy entire cds from iTunes. I'd rather not have the clutter of having the "hard copy" lying around. I used to download a lot illegally (back in the Napster days, before they got sued and forced to go to a pay model) but have basically stopped that. For a very short time, I had Kazaa on my computer, but the Spyware, crappy recordings, incorrect info, etc wasn't worth the hassle. I did, however, get a few Corky and the Juicepigs tracks that you can no longer buy by downloading them off of Kazaa, and I was well-pleased. I'd rather just cough up the buck a song, and know exactly what I'm getting. |

OMG! What's the catch?? There must be one! I just went and downloaded a song (with the 20 cents they gave me for registering and confirming my email address). While the downloading process is a bit of a pain in the arse, it's definitely worth the cheap price. But there MUST be a catch. I don't see how they'd be able to offer the same songs as iTunes (at higher quality encoding) for so cheap! |

I can't see that - they would have been shut down by now because realistically, that's WORSE than peer to peer, as they are offering the music in a store like format (complete with album art pictured). But I'm curious as to how they are doing it... |

Kenny, I may be wrong on this, but I remember reading (I wish I could remember the source) that very little of ANY recording gets to the artists. The real money is in touring, and the record sales just serve as a kickstart for a tour. Perhaps someone closer to the industry can inform me... |

I think it depends on the laws of the country in question. Norway seems to have no laws concerning the offering of Hollywood movies online. I would bet that, in lieu of going after the site they would go after the consumer in the US who is breaking a law.
Why can you often buy the DVD associated with an album for less than the CD? Surely putting a DVD together costs more than a cd? I have, on several occasions, bought the DVD and pulled the tracks that I like off and put on my mp3 player. |

Is it, in fact, illegal? Has it ever been tested in court? I know RIAA was threatening to take people to court, but they all 'settled' for a fine, rather than defending themselves in court. My understanding is that it is legal for me to make a copy for myself, even to give a copy to a friend. Selling it, however, is clearly illegal. :ph43r: |

Or sharing it to the masses. That's why, whenever I would use one of those P2P downloading programs, I would always turn sharing off. Of course, the default setting is to have sharing on...and thats how they get so many people. |
