From the WSJ: The Bush administration will bar statements made under torture from its Guantanamo Bay military courts, reversing a White House decision in July that could have allowed such evidence to convict suspected terrorists held at the U.S. naval base in Cuba. The new rule, expected to be issued this week, comes before Supreme Court arguments next Tuesday over the legality of the special courts, known as military commissions, which President Bush authorized after the Sept. 11, 2001, terrorist attacks to prosecute non-U.S. citizens for war crimes. A Defense Department spokeswoman said the regulation had been approved but not yet publicly released by the Pentagon's general counsel, who oversees the commission system. ------------- Too bad it took the threat of impending Supreme Court review to get them to reach this conclusion. |

Not that I disagree, but I can see the argument: "Was this information obtained through torture?" "No, judge." "Well, you threatened to turn off his air conditioning, didn't you?" or "Was this information obtained through torture?" "No, judge." "Well, you broke his arms, didn't you?" The court will, no doubt have to define where in the spectrum that line is, right? |

But I thought we didn't torture. So why would they even say this? I guess the real change in course is that this is a tacit admission that they have engaged in torture. (On a tangential subject: Isn't this the third or fourth time the Bushies have made a dramatic change in course right before a case challenigng their policie was to be heard by the Supreme Court? Kind of tells us that they knew all along what they were doing was not acceptable under our Consitution, but they did it anyway. So much for protecting and defending the Constitution!) |

To be fair, one of the reasons the W-ettes opposed this rule was because some, like Rick, might say that it implicitly acknowledges that torture occurred. They were careful to say that we don't condone torture, and it didn't happen, but this way there can be no doubt that we are following the international conventions. Doing it right before the Supremes hear the case is mighty fishy, though. |
