Do you feel the Court has the right to determine the Constitutionality of a law? If so, each judge must then interpret the Constitution in some way to make such a determination, even if the judge is interpreting what he/she believes the original intent was. Thus, we are right back to judicial activism. You simply want judges who interpret based on your view of things. But interpret they must do. (And, of course, the entire concept of your one-man, one-vote theory was imposed by judicial fiat on the states by the Warren Court, if I am not mistaken, and was considered judicial activism in the extreme at the time.) |

I haven't expressed any opinion about his qualifications. I am waiting for him to go through the process. The type of judge I might accept on an appellate court is completely different from the type of judge I might accept on the Supreme Court. |
