Royal Mint Face Value Silver Coins...

Hi,
I've been buying a few of these as they have been issued over the last few years, thinking if they don't go up as collectables I could at least cash them on for face value.
I posted on a FB coin site over the weekend asking if they were going for a premium to face value, only to be told that they are not worth face value, the term legal tender is miss leading and bank won't take them! There was some press on it last January that I missed.

Does anyone know how the Royal Mint cab get away with this?

Please help.

I didn't find the right solution from the Internet.
