I sat around in a room for about 3-4 hours for a few days, then heard the case was settled out-of-court. Got like $80 for it, and I had a book or my DS with me, so it wasn't exactly a big deal. |

A good family friend, someone I know personally, is a federal prosecutor who is involved in picking jury members all the time. He's an expert, and here's what he says: -Both the prosecution and the defendant have a certain number of challenges, used to remove a potential jury member that they don't like. There are two types of challenges: peremptory challenges and challenges for cause. -A challenge for cause is used by either side if they think (and can reasonably prove) that a potential juror might be biased or unable to deliver a partial verdict for some reason. Most of the suggestions in this topic would theoretically work because they would prove, based on your words, that you are stupid and incapable of delivering a reasonably accurate verdict. Racism, implied apathy etc. falls into this category. -A peremptory challenge can be used to remove a prospective juror for any reason. You don't need to prove anything to the judge, unlike in a challenge for cause. Either the persecution or defendant can just kick someone out with a peremptory challenge, though they must use them wisely because each side has a limited number (varies by state). Book's idea of revealing yourself to be an intelligent person very well might work for this reason because sometimes one side is trying to get stupid people into the jury box in order to deliver the wrong verdict. [This side is almost always the defense, by the way, because despite what the Phoenix Wright games portray, governments tend to dismiss all but the strongest cases before they make it to court because the time and expense of a court case is too high for governments to try cases in which more than a miniscule amount of doubt exists, though this more refers to the federal level so it might be different in state courts.] Either way, trying to be intelligent has at least as good a chance of getting you kicked off as trying to be racist or whatnot. -If you do go the racism/stupid route, do so very cautiously. I heard from the family friend of one time in which a person was so incredibly obviously trying to act stupid to get out of jury duty, and was not actually racist or anything, but kept answering questions trying to get out of it. The judge finally said "ok, you've spent the last five minutes trying to convince me that you are unable to deliver a reasonable verdict, and I now think you're correct, only because you'd be so angry at getting picked that you'd do whatever it took to end deliberation as quickly as possible. So I'm going to dismiss you from the panel of prospective jurors, but I don't like your attitude so this is what's going to happen. You're going to sit in with this jury, go to all the meetings, log all the hours, and do everything they would do except vote. Because I see this trick pulled all the time and I'm sick of it being rewarded. Skip out and you get contempt of court." So yeah, try not to be like that guy. -Also, if you lie to the court and they catch you, a mountain of bad annoying things happen that easily avoidable if you just tell the truth. Don't do it. -So the judge will call you up from the panel of prospective jurors and ask you some questions, but chances are one side or the other has already decided to dismiss you. Legal teams tend to dismiss or accept prospective jurors based on demographics more than anything else. I a baby was kidnapped, the prosecution is going to tend to pick mothers who would sympathize with the victim of such an act. During an internet fraud case, the defense would tent to pick older jurors who might not fully grasp the facts of the case or realize exactly how the money was stolen. So there's relatively little you can do. -The big secret: the easiest way to get off is to get lucky by being at the back of the list, because after they find 12 jurors both sides can agree on for a case, everyone else gets to go home. -If you do get on, it's actually not that bad. If you can follow instructions at a fifth grade skill level it's easy, and the pay is fine for what you're doing. Plus cases end early for a number of reasons (settled out of court, etc.) so it's not all bad. Edited by Frog, Jul 12 2010, 10:50:54 AM.

Yeah. From my (fairly limited on this subject) there's a respectable chance that even if you get through the other steps, the case will be settled out of court right before they go in or whatever if it's a civil case. Plus your name's pretty close to the end of the alphabet so they might just get enough jurors before they reach you. Maybe. |

My mother once got called in for jury duty. She has an infallible excuse: She is legally insane. As for myself, I've never been called, but if I were, I would just go. I don't have anything better to do. |

They originally had me scheduled to go several months earlier and I told them I was a student. They requested a copy of my class schedule and then pushed it back until summer. For some reason they said not to show up today though. I'm supposed to call them sometime after 6 to find out when and/or whether to show up. It's federal court, btw. $40 a day. Dunno whether you have to actually get picked for the jury before they start giving you money, though. If I did not have vacation coming up in less than a week I would probably want to get picked. |
