This is a new one on me , please please me on ebay , look at the labels and text for this one, I hope no one on here has bid on this because its up to 11 bids and £883.89 Do people who bid big money for these records have no idea what they're bidding on? Ive not saw a fake PPM demo before Ive saw Love Me Do , She Loves You , I Want to hold Your Hand , Help and Lady Madonna. But I suppose they're all out there somewhere. Do you agree with me on this disc , I dont think its even in question ??? |

I assume it's this one. Am I wrong or one easy way to recognize a fake is to have alook if there are the demos stampers JR? Those would be very hard to fake, wouldn't they? |

Someone ought to report that listing. Imagine paying a grand plus for that!!! :angry: I have a question with regards to Beatles demo's anyway. If a record is for demo purposes and NOT FOR RESALE then is it not fraudulent to sell them. Are they technically still the property of EMI? |

In a word, NO. The restrictions on resale apply only to the person/company to which EMI provided it. I am sure there are specific laws in some countries that control the relationship between the copyright owner and those who receive promotional items. I also susect that there is often a contractual agreement between the two parties. Once the recipient of the promo item (a DJ for example) breaks the law/contract/whatever, the subsequent owner is not bound by the agreement between the DJ and EMI. EMI's only recourse is against the DJ, not the peson who bought the LP from the DJ. The same concept applies to bootlegs. It is illegal to make and sell bootlegs, and it may be illegal to resell them if you are are in the business of reselling (i.e., a record shop can't buy a truckload of bootlegs and then thumb their nose at the record company). Once the first retail sale happens, however, the LP is just another piece of physical property. EMI can't demand that the police seize and destroy a collector's bootleg and promo items. Once the retail sale occurs, the LPs cease to be contraband, and EMI's recourse is to sue the original seller for damages. |

Thanks socorro. It's all starting to make sense to me now with your post. To elaborate further, if a seller lets say on ebay for example, sells a fake demo or acetate (like the original post on this thread), can the buyer make a claim against the seller for misleading info? Or are the sellers ahead of the game due to the very description with the words 'demo' or 'acetate'? |

Hi TheItalianFab4. I think the stampers you decribe make these items more credible...(are you sure JR is correct for all demo's?). I expect someone could engineer a machine to do the job? As you say, I agree. Never rely on demo's. |
